Terms of Service

This English version is provided for reference only. In the event of any conflict, the Korean version (이용약관) prevails.

These Terms govern the rights, obligations, and responsibilities between Foundry ("the Company") and users in connection with openfoundry.co and related services ("the Service").


1. Purpose and Definitions

  1. These Terms set out the conditions and procedures for using the Service and the rights, obligations, and responsibilities of the Company and users.
  2. Definitions:
    • "User": a member or non-member who uses the Service under these Terms.
    • "Member": a person who has registered an account by providing personal information.
    • "Content": all material a user uploads or creates on the Service (models, datasets, spaces, posts, etc.).

2. Posting and Amendment of Terms

  1. The Company posts these Terms on the Service so users can easily review them.
  2. The Company may amend these Terms within the scope permitted by applicable law.
  3. When amending, the Company will announce the effective date and reason at least 7 days before the effective date (30 days for changes that are disadvantageous or material to users).
  4. If a user does not agree to the amended Terms, the user may stop using the Service and withdraw.

3. Provision and Change of the Service

  1. The Company provides services such as storage and collaboration for AI models/datasets/spaces, synthetic data generation, GPU computing, and notifications.
  2. The Company may change or suspend all or part of the Service for operational or technical reasons, with prior notice for material changes.
  3. The Service may be provided free of charge and may include beta/trial features.

4. Registration and Account

  1. A user applies to register per the Company's procedures and becomes a member upon the Company's acceptance.
  2. Members must keep their account information up to date and are responsible for managing their account.
  3. Members must not allow third parties to use their account.
  4. The Company may implement verification procedures such as email verification.

5. User Obligations and Prohibited Acts

Users must not:

  1. Misappropriate others' information or register false information.
  2. Infringe the IP rights, portrait rights, reputation, or other rights of the Company or others.
  3. Upload or distribute malware or secrets (credentials).
  4. Interfere with stable operation of the Service (excessive requests, automation abuse, security circumvention, etc.).
  5. Upload or distribute content that violates law or public morals.
  6. Engage in other acts the Company reasonably deems inappropriate.

6. Rights and Responsibility for Content

  1. Rights to content uploaded or created by a user belong to that user.
  2. Users are responsible for holding lawful rights to, or complying with lawful licenses for, the content they upload, and warrant that it does not infringe third-party rights.
  3. The Company may use content to the extent necessary to provide and operate the Service (storage, display, backup, transmission).
  4. The Company may restrict access to or hide content suspected of violating law, infringing rights, or breaching these Terms.

7. Use Restrictions and Termination

  1. If a user violates these Terms or applicable law, the Company may, after prior notice (or subsequent notice in urgent cases), restrict use or suspend/terminate the account.
  2. A user may withdraw (terminate the agreement) at any time via Settings > Account; related data is destroyed per the Privacy Policy.

8. Limitation of Liability

  1. The Company is not liable for damages arising from causes beyond its reasonable control, including force majeure, the user's fault, or failures of third-party services (storage, email, etc.).
  2. Where the Service is provided free of charge or as beta/trial, the Company does not warrant the completeness, accuracy, or fitness for a particular purpose of the Service, to the extent permitted by law.
  3. Users are responsible for backing up important data; the Company limits liability for data loss to the extent permitted by law.
  4. The limitations in this Article apply within the bounds of mandatory law, including the Act on the Regulation of Terms and Conditions.

9. Minors

Children under the age of 14 are restricted from registration and use of the Service. If a user is confirmed to be under 14, the Company may restrict the account.

10. Governing Law and Jurisdiction

  1. These Terms and use of the Service are governed by the laws of the Republic of Korea.
  2. Any dispute between the Company and a user shall be subject to the Seoul Central District Court as the court of first instance.

11. Dispute Resolution

The Company and users shall endeavor to resolve disputes amicably through mutual consultation; failing agreement, a suit may be filed with the competent court in Section 10.
